Escalation Clause

Competition is so fierce that creativity when presenting offers is becoming paramount.  Here is one such tool that has won our clients 2 offers over the last week.  The Escalation clause can be used both by a listing agent or a Buyer’s agent. It assures the Seller that they aren’t leaving any money on the table and wins the Buyer a deal at a certain price and terms.

Escalation Clause – In the event Seller receives one or more additional written bona fide offers to  purchase the Property with terms acceptable to Seller (“Other Offer(s)”) and from which Seller would receive a higher Net (contract sales price less any seller concessions) than the Net reflected in this offer, then this Contract sales Price shall automatically increase by _______________ above any other Offer’s net to Seller, not to exceed a maximum sales price of ____________.
